Filing After Bankruptcy Reform

How Bankruptcy Reform Has Changed the Filing Procedure

I need to know if I need to file bankruptcy under Chapter Seven or Chapter Thirteen as a single person.

I have a lot of old debts and I lost my job over 6 months ago and now make about 1/3 what I used to make. I am at wits' ends with bills please advise.

It sounds like you will still qualify for a Chapter Seven filing.

Under the revised bankruptcy law with came into effect in October, 2005, you must go through credit counseling before you file. The counselor will let you know if you qualify for a Chapter Seven or if you have to go through Chapter Thirteen.

The way I understand it, the counselor basically directs you to the proper chapter to file under, if he deems you suitable for bankruptcy at all.

You have to find out what the procedures you will have to follow in your state are.

So either call a qualified bankruptcy lawyer or the bankruptcy court to see which counselors in your area are qualified by the court to do this for you.
